1. General Conditions
1.1 These conditions together with your completed Search Request Form ("SRF") constitute your entire agreement with the Unclaimed Assets Register ("UAR").
1.2 No waiver, modification of or addition to any of these conditions shall have any effect or be binding upon Unclaimed Assets Register unless in writing and signed by an authorised representative of UAR.
  
2. General Procedures
2.1 Following receipt of your duly completed "SRF" and payment of the correct fee, UAR will search its database and make enquiries of such institutions in the United Kingdom as shall be deemed appropriate for the relevant categories of unclaimed assets in the content of the information you have provided.
2.2 UAR may undertake a search for the purposes of verifying your identity. To do so Unclaimed Assets Register may check the details you supply against your particulars on any databases (public or other) to which the Unclaimed Assets Register and Experian have access. They may also use your details in the future to assist other companies for verification purposes. A record of the search will be retained.
2.3 UAR will use reasonable efforts to report the results of searches, within 28 days of UAR's receipt of your SRF.
2.4 Any potential Matches will be notified to you as a match reference number for the relevant financial institution together with the relevant contact details of the institution.
2.5 A Match does not guarantee any actual entitlement.
2.6 UAR will not retrieve any assets for you under this search service. You will need to contact the financial institution directly, and satisfy their identity and entitlement authentication procedures before collecting any such unclaimed asset.
2.7 ‘Match’ for this purpose means an apparent similarity between the details you have provided and the details held by the financial institutions searched by the Unclaimed Assets Register relating to entitlements to unclaimed assets.
  
3. Data Protection, Confidentiality, and Search Results
3.1 UAR is registered under the Data Protection Act (1998) (DPA) as a data controller. The information provided by you will be kept confidential and will only be disclosed to financial institutions for the purpose of reconciling you with potential unclaimed assets and updating your address. Financial institutions are required to comply with the DPA.
3.2 Any information from a financial institution produced in response to a search enquiry will be kept confidential by Unclaimed Assets Register and only used as described in these Terms and Conditions.
3.3 All the information you have provided and particulars of Matches may be kept by the UAR for up to 6 years. This information may be used by UAR for any further searches you may request for other financial assets and to keep you informed of other UAR services which may be of interest.
3.4 Under the DPA an individual may request details of information relating to him/her.
  
4. Standard of Service and UAR's Responsibility to You
4.1 The success of a search is dependent upon many variables. UAR’s search service seeks to manage such variables by using computerised and/or manual analysis to match information you supply with information of financial institutions. However, such information may be incomplete, out of date and/or inaccurate in certain respects. Consequently, Unclaimed Assets Register cannot give any assurance that:
  1. any unclaimed assets exist;
  2. your search will give rise to a Match;
  3. any Match will in fact relate to you or give rise to any asset to which you are in fact entitled; and
  4. there are no other entitlements or claims to any unclaimed asset.
4.2 Given the nature of UAR’s service its liability to you whether for breach of contract, negligence or otherwise shall not in any event exceed twice the amount of your search fee.
  
5. Authority
5.1 UAR reserves the right to reject a Search Request Form. In such event we will not make any charge and shall make a full refund.
5.2 It is a criminal offence to obtain any financial asset by deception or attempt to do so. Unclaimed Assets Register respects the privacy of individuals and seeks to guard against the unauthorised access to or misuse of information. Therefore UAR:
  1. requires all searchers to confirm their identity and/or authority in order to receive details of a potential Match.
  2. confines search results to a financial institution’s contact address and a discrete Match reference number; and it is for the financial institution to apply its own authentication procedures.
  For the protection of those genuinely entitled to unclaimed assets, Unclaimed Assets Register reserves the right to notify any concerns it may have as to the propriety of a search request to the police.
